The victim, now 13, testified that she was 11 when the incident occurred. She told the court that Ashimiyu, who was known in her compound where he washed cars and ran errands, sexually assaulted her after coming upstairs while she was outside.

The girl’s grandmother later discovered the abuse after finding her with the convict. Ashimiyu was reportedly beaten by residents before being handed over to the police.

During the trial, the prosecution was led by A.A. Adeniyi. The defence called one witness, Ibrahim, who said he was not present when the incident happened and only heard about it from a neighbour. He told the court that Ashimiyu claimed he was “only playing” with the child.

In her judgment, Justice Soladoye described the survivor’s testimony as credible and coherent. The court held that the prosecution proved beyond reasonable doubt that the victim was a child and that the offence was committed without her consent.

The judge also noted that Ashimiyu did not testify in his own defence. She subsequently sentenced him to life imprisonment and ordered that his name be entered in the Lagos State Sexual Offenders Register.
