The order followed an ex parte application filed by Afolabi through his counsel, A. Labi-Lawal, SAN, pursuant to the Fundamental Rights (Enforcement Procedure) Rules, 2009.

Afolabi was arrested by operatives of the NDLEA on August 13 at the Murtala Muhammed International Airport, Lagos, while preparing to travel to Paris.

His legal team approached the court after he had spent more than 14 days in custody without, according to the application, being formally charged or arraigned.

The applicant is asking the court to intervene in what he contends is a violation of his fundamental rights arising from his continued detention.

The court, in response to the application, directed the NDLEA to produce Afolabi before it for the matter to be heard.
